These proposed minute orders contain information concerning the receipt of bids for
highway improvement contracts. The department may reschedule receipt of bids for
those projects where the commission rejects all bids. Those bids accepted by the
commission will result in conditional contract awards to the low bidders. Contract
award conditions may involve securing funding from other sources, the contractor's
ability to satisfy federal DBE subcontracting requirements, or other requirements as
outlined in the project bid proposal.

b. Real Estate Dispositions
The commission must approve the sales, transfers, and exchanges of state rights of way and
other real properties that are no longer needed for a state highway purpose. It must
also approve, accept, and acknowledge donations to the state of real property
that is valued at $500 or more.
(1) Caldwell County - SH 130 - Consider the release of an easement to the
underlying fee owner, Commerce Park 183, LLC. Minute Order 115379,
dated November 15, 2018, is rescinded by this minute order (MO)
The district has determined that the easement is no longer needed for
highway purposes. The easement may be released to the requestor.
(2) Dallas County - US 75 - Consider the quitclaim of the state’s interest
including mineral rights, if any, to comply with a reversionary clause
contained in the instrument that originally conveyed the interest to the
state (MO)
Devereaux Smith has requested that the tract be quitclaimed to honor the
reversionary clause. The district has determined that the tract is no longer
needed for highway purposes.
(3) Denton County - I-35 - Consider the sale of right of way to the Town of
Northlake (MO)
The district has determined that the land is no longer needed for highway
purposes. The Town of Northlake has requested to purchase the land, and
it may be sold to the requestor.
(4) Lubbock County - US 87 - Consider the release of an easement to the
underlying fee owners Kubie Properties, LLC, Castle One Properties,
LLC, Castle Two Investments, LLC, William W. Choate, Becky White,
Joanna Jones, Connie Choate, and Karen Choate (MO)
The district has determined that the easement is no longer needed for
highway purposes. The easement may be released to the requestors.
(5) Potter County - US 287 - Consider the sale of right of way to an abutting
landowner (MO)
The district has determined that the land is no longer needed for highway
purposes. An abutting landowner has requested to purchase the land, and
it may be sold to the requestor.
(6) Randall County - SS 48 - Consider the removal from the system, transfer
of jurisdiction, control, and maintenance, and the transfer of right of way
to the City of Canyon (MO)
The district has determined that a segment of SS 48 is no longer needed as
part of the system. The City of Canyon (city) has agreed to assume
jurisdiction, control, and maintenance and has requested that the right of
way be transferred to the city. The right of way may be transferred to the
city without cost to remain in use for public road purposes, and will revert
to the state if it ceases to be used for public road purposes.
(7) Red River County - FM 37 - Consider the sale of right of way to an
abutting landowner (MO)
c. Reports
(1) Compliance Division Report
State law requires the commission to establish a compliance program,
which must include a Compliance Division to oversee the program. The
Compliance Division is responsible for acting to prevent and detect
serious breaches of department policy, fraud, waste, and abuse of office,
including any acts of criminal conduct within the department. The
Compliance Division is required to provide a monthly report to the
commission regarding investigations and a summary of information
relating to trends and recommendations.
(2) Environmental Report
Consider the acceptance of the report on projects being processed under
the department’s environmental review process (Report)
The report identifies projects being processed under the department’s
environmental review process. A report must be submitted twice a year to
the commission, as required by Transportation Code, §201.762(a).
(3) Environmental Hearing Report
Consider the acceptance of the Environmental Impact Statement Positive,
Negative, or Neutral Public Comments Report for the May 2018 public
hearing US 290/SH 71 (Oak Hill Parkway) from State Loop 1 (MoPac) to
west of Ranch-to-Market Road (RM) 1826 and from US 290 to Silvermine
Drive (Report)
Per Transportation Code §201.811(b) and 43 TAC §2.107(e)(2), this
report lists the number or positive, negative, and neutral public comments
received at a public hearing held for the referenced project.
d. Highway Designation
Travis County - In the city of Austin, consider designating Ranch to Market
Spur 620 (RS 620) on a new location on the state highway system (MO)
This minute order designates Ranch to Market Spur 620 (RS 620) on a new
location on the state highway system from RM 620 eastward to RM 2222, a
distance of approximately 0.5 mile.
e. Designation of Access Control
(1) Chambers County - SH 99, just east of the city of Baytown - Consider
the designation of one location on the west side of SH 99 at which access
will be permitted to the abutting property (MO)
The designation of one 40.2-foot break in the control-of-access line will
allow the abutting landowner to open one commercial driveway for access
to and from the west side of SH 99. The district has determined that
access may be permitted at the designated location.
(2) Travis County - SH 130, in the city of Pflugerville - Consider the
designation of one location on the SH 130 northbound frontage road at
which access will be permitted to the abutting property (MO)
The designation of one 41-foot break in the control-of-access line will
allow the abutting landowner to open one commercial driveway for access
to and from the SH 130 northbound frontage road. The district has
determined that access may be permitted at the designated location.
f. Speed Zones
Various Counties - Consider the establishment or alteration of regulatory and
construction speed zones on various sections of highways in the state (MO)
This minute order establishes or alters regulatory and construction speed zones
on various sections of highways in the state.
